Host Agreement

1. Scope

This Host Agreement applies to every person who lists or manages a property on Pacific Luxe Stays, operated as a sole proprietorship. It is in addition to the Pacific Luxe Stays Terms of Service. Where this Agreement addresses a host-specific subject in more detail, this Agreement controls for that subject.

2. Ownership and authorization

You represent and warrant that you own the property or hold current authority from the owner to list, rent and manage it on the Platform, and that all information you provide is accurate. You will provide evidence of that authority if we request it. Listing a property without authority is a material breach.

3. Permits, licenses and local law

You represent that you hold every short-term-rental permit, license, registration and approval required for the property, that it is valid and current, and that you comply with occupancy, noise, parking, safety and other local short-term-rental requirements. You will provide the permit number, issuing jurisdiction, expiration date and supporting documents on request. We may block publication or bookings where authorization cannot be verified. Our internal "verified" marking is a platform process step only and is not a guarantee of the permit's continuing validity.

4. Accurate listing representations

You are responsible for the accuracy of photographs, descriptions, amenities, sleeping capacity, location, pricing, fees, availability, minimum-stay requirements, house rules, accessibility statements and safety information. You will keep the listing and calendar materially accurate and correct inaccuracies promptly.

5. Property safety and habitability

You will provide a safe and legally habitable accommodation, disclose known material hazards, and maintain smoke alarms, carbon-monoxide alarms and other legally required safety equipment. You will address material safety issues promptly.

6. House rules and non-discrimination

You may set lawful house rules, which are presented to guests before they book. Your rules and your hosting conduct must comply with applicable anti-discrimination, accessibility and accommodation laws.

7. Insurance

You are responsible for determining and maintaining the insurance you need, which may include homeowner, landlord, short-term-rental and liability coverage. Pacific Luxe Stays does not provide insurance and is not an insurer.

8. Booking commitments and cancellations

You will honor confirmed reservations except where a legitimate cancellation right applies. Repeated host cancellations, calendar inaccuracy or failure to honor reservations may result in listing removal or account suspension.

9. Fees, commission and payout calculation

Pacific Luxe Stays retains the platform fee or commission disclosed to you in the Platform and in your listing economics. Your payout for a booking is calculated from the applicable booking economics after those disclosed deductions. Taxes and refundable security deposits are not host earnings unless a specific lawful arrangement expressly provides otherwise. Our fee schedule is configurable and may change prospectively; a change does not alter a booking already confirmed.

10. Payout timing and Stripe Connect

Payouts require a connected Stripe account that has completed the required onboarding and verification. The guest is charged when the reservation is confirmed and that payment succeeds. Your proceeds are not transferred to you at that moment: they are held by Pacific Luxe Stays and released separately.

For a reservation shorter than twenty-eight (28) nights, your payout for the reservation is scheduled for release approximately twenty-four (24) hours after the reservation's scheduled check-in time, and is then transferred to your connected account.

For a reservation of twenty-eight (28) nights or longer, your proceeds are paid in installments. The installment covering the first period of the stay is scheduled for release approximately twenty-four (24) hours after the scheduled check-in, and later installments are scheduled in approximately monthly periods. An installment is only released after the corresponding guest payment for that period has actually been collected successfully. We will never pay you money that has not been successfully collected from the guest.

Payout may be delayed or withheld beyond the scheduled release time where there is suspected fraud, an active payment dispute, a failed or uncertain payment, an identity or verification concern, a listing violation, a cancellation or refund issue, a material guest complaint, evidence that the reservation may not be legitimate, a legal or compliance reason, or incomplete payout onboarding. We do not guarantee a payout date regardless of those events.

11. Chargebacks, payment disputes, refunds and recovery

You acknowledge that guest payments may be reversed, disputed, refunded, charged back, or otherwise recovered after a Host payout has been initiated or completed.

As between you and Pacific Luxe Stays, you are financially responsible for amounts arising from a reservation to the extent such amounts relate to your accommodation, conduct, listing, cancellation, failure to provide the booked stay, material misrepresentation, policy violation, guest refund entitlement, payment dispute, or chargeback.

You authorize Pacific Luxe Stays and its payment processor to recover amounts you owe by any lawful method available through the Platform or the payment processor, including: reversing or partially reversing a transfer; deducting the amount from pending or future payouts; offsetting the amount against other amounts otherwise payable to you; placing a temporary hold or reserve on your payouts; debiting your connected payment account where permitted by the payment processor and applicable law; and requesting direct repayment from you.

If a guest dispute or chargeback occurs after a Host payout has been made, Pacific Luxe Stays may immediately attempt to recover the corresponding amount from you. Where an amount cannot be recovered in full, the unrecovered balance is recorded as an amount you owe and may be offset against your future payouts until it is repaid.

You must cooperate in good faith with dispute and chargeback investigations and timely provide requested records, communications, photographs, check-in records, cancellation information, and other evidence reasonably needed to contest a dispute.

Pacific Luxe Stays does not guarantee that any payment, payout, dispute, or chargeback will ultimately be successful or irreversible.

We will not take funds unrelated to your hosting activity and obligations under this Agreement. Nothing in this section limits any responsibility that Pacific Luxe Stays cannot lawfully disclaim or transfer under applicable law, card-network rules, or payment-processor requirements.

12. Taxes

You are responsible for your own income taxes and for any lodging tax obligations that remain assigned to you as the operator, including registration, collection where applicable, reporting and remittance. Where Pacific Luxe Stays is authorized or required to collect and remit a lodging tax for a jurisdiction, we may do so and the amount is shown to guests at checkout. You will provide tax information we are required to collect.

13. Damage claims

Damage claims follow the Damage & Security Deposit Policy. You will submit claims within the stated window with reasonable documentation, such as dated photographs, a description of the damage, and repair or replacement estimates or invoices. Undocumented or arbitrary deductions are not permitted.

14. Cooperation, investigations and recordkeeping

You will cooperate reasonably with our investigations of safety concerns, fraud, disputes, chargebacks and regulatory inquiries, and will provide relevant records on request. You will keep records of permits, reservations, and material communications for as long as applicable law requires.

15. Optional and requested verification evidence

We may request additional evidence, such as proof of ownership or management authority, identification, or property photographs, where reasonably necessary for verification, safety or compliance. Where evidence you previously provided remains on file, it is retained as part of our records.

16. Suspension and removal

We may suspend, unpublish or remove a listing, and suspend or terminate a host account, for reasonable cause as described in the Terms of Service, including invalid permits, safety concerns, fraud, materially inaccurate listings or repeated policy violations.

17. Content and intellectual property

You retain ownership of the listing content you own. You grant Pacific Luxe Stays a worldwide, non-exclusive, sublicensable, royalty-free license to host, display, reproduce, format, distribute and market that content to operate and promote the marketplace and your listing. You warrant that you hold the rights to the photographs and content you upload.

18. No guarantee of bookings or income

Pacific Luxe Stays makes no promise or projection of any number of bookings, occupancy level, revenue or income. Marketplace demand varies and is not guaranteed.

19. Host indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Pacific Luxe Stays and its personnel from third-party claims, losses, damages, liabilities and reasonable costs arising out of your property; listing without authority; permit or license violations; your violations of law; materially false listing information; or your negligence or misconduct. This indemnity does not cover Pacific Luxe Stays' own fraud, willful misconduct or gross negligence, or any other liability that cannot lawfully be shifted.

20. Limitation of liability, governing law and disputes

The limitation of liability, disclaimers, governing-law, venue and dispute-resolution provisions of the Terms of Service apply to this Agreement. Mandatory arbitration is not in force.

21. Electronic signature

You accept this Agreement by checking the required boxes and typing your full legal name as your electronic signature before submitting a property for review. Your typed signature is recorded as evidence of assent. It does not replace Stripe identity or payout verification, which remain separate requirements.

22. Notices

Formal, contractual and legal notices to Pacific Luxe Stays must be sent to legal@pacificluxestays.com, and may also be sent by mail to Pacific Luxe Stays, 1551 Kenneth Drive, Santa Ana, CA 92705. Notices to you may be given electronically to the email address on your account. Ordinary customer-support questions should go to support@pacificluxestays.com.
