Guest Booking Agreement

1. What this agreement covers
This Guest Booking Agreement applies to the specific reservation you are paying for. The booking screen shows the property and host, the check-in and check-out dates, the guest count, the nightly subtotal, the cleaning fee, the Pacific Luxe Stays service fee, applicable taxes and assessments, any refundable security deposit, and the final total. Those booking-specific details, the cancellation policy version shown to you, and the property's house rules are part of this agreement for your reservation and are recorded with your booking.
2. Payment authorization
By completing checkout you authorize the charge of the total amount displayed for this reservation, processed through Stripe. Your reservation is confirmed only when that payment succeeds and the Platform records the booking as confirmed. Host proceeds are held and released later under the Platform's payout rules.
3. Cancellation and refunds
The Cancellation & Refund Policy version shown to you before payment applies to this reservation and is stored with your booking. When you cancel determines your refund eligibility. Cleaning and security-deposit amounts may be treated differently from lodging charges, taxes are adjusted according to applicable law and the Platform's tax rules, and refunds may take time to appear depending on your bank or card issuer.
4. House rules and occupancy
You agree to follow the property's house rules, to stay within the stated occupancy limit, to accurately disclose the number of guests, and to comply with check-in and check-out expectations shown for the property. Unauthorized parties or events are not permitted where the property prohibits them.
5. Damage responsibility
You are responsible for damage caused by you or your authorized occupants, to the extent permitted by law. The Damage & Security Deposit Policy explains the claims process, the documentation a host must provide, and how a refundable security deposit is handled.
6. Prohibited conduct
Illegal activity, harassment, dangerous activity, damage to the property, nuisance or excessive noise, misrepresenting your guest count, and use of another person's payment credentials are prohibited and may result in cancellation without refund to the extent permitted by law and by the applicable cancellation policy.
7. Billing problems and payment disputes
If something is wrong with your charge, contact support@pacificluxestays.com first so we can review it quickly. This does not limit your rights with your card issuer or under applicable law. When responding to a payment dispute, we may provide the booking record, the agreement versions you accepted, and related evidence to our payment processor.
8. Relationship to the Terms of Service
The Pacific Luxe Stays Terms of Service apply to this reservation, including the marketplace-role, disclaimer, limitation-of-liability, indemnification and dispute-resolution provisions. Where this agreement addresses a booking-specific subject, it applies to that reservation.
9. Who you are contracting with, and notices
This reservation is with Pacific Luxe Stays, operated as a sole proprietorship, in its marketplace role described in the Terms of Service, together with the independent host of the property.
