Pacific Luxe Stays
Guest Booking Agreement
Version 1.0·Effective October 17, 2026
1. What this agreement covers
This Guest Booking Agreement applies to the specific reservation you are paying for. The booking screen shows the property and host, the check-in and check-out dates, the guest count, the nightly subtotal, the cleaning fee, the Pacific Luxe Stays service fee, applicable taxes and assessments, any refundable security deposit, and the final total. Those booking-specific details, the cancellation policy version shown to you, and the property's house rules are part of this agreement for your reservation and are recorded with your booking.
2. Payment authorization
By completing checkout you authorize the charge of the total amount displayed for this reservation, processed through Stripe. Your reservation is confirmed only when that payment succeeds and the Platform records the booking as confirmed. The host is the merchant of record. Stripe processes the charge directly on the host's connected account and pays the host's bank according to that account's schedule.
3. Cancellation and refunds
The Pacific Luxe Stays Strict Cancellation & Refund Policy applies to this reservation. The version shown to you before payment is stored with your booking and is the version used to calculate any refund; a later change to the policy does not alter this reservation.
In summary, and as set out in full in that policy: if you cancel within 24 hours after paying and your check-in date is still at least 7 full days away, you receive a full refund. Otherwise, cancelling 14 or more days before check-in refunds your accommodation charges in full; cancelling 7 to 13 days before check-in refunds half of your accommodation charges; cancelling less than 7 days before check-in refunds no accommodation charges; and after check-in has begun, or if you do not arrive, unused nights are not refunded. When cancellation occurs before scheduled check-in, the cleaning fee and any refundable security deposit are returned in full, and lodging taxes are recalculated against the accommodation amount actually retained.
Before you confirm a cancellation, the Platform shows you the exact amounts: the cancellation time, your check-in date, the policy tier that applies, what you paid, what will be refunded automatically, and what is not refundable. A refund larger than the policy guarantees is not automatic — you may ask your host to consider one, and the decision is the host's.
Refunds are returned to your original payment method and the time they take to appear depends on your bank or card issuer.
4. House rules and occupancy
You agree to follow the property's house rules, to stay within the stated occupancy limit, to accurately disclose the number of guests, and to comply with check-in and check-out expectations shown for the property. Unauthorized parties or events are not permitted where the property prohibits them.
5. Damage responsibility
You are responsible for damage caused by you or your authorized occupants, to the extent permitted by law. The Damage & Security Deposit Policy explains the claims process, the documentation a host must provide, and how a refundable security deposit is handled.
6. Prohibited conduct
Illegal activity, harassment, dangerous activity, damage to the property, nuisance or excessive noise, misrepresenting your guest count, and use of another person's payment credentials are prohibited and may result in cancellation without refund to the extent permitted by law and by the applicable cancellation policy.
7. Billing problems and payment disputes
If something is wrong with your charge, contact support@pacificluxestays.com first so we can review it quickly. This does not limit your rights with your card issuer or under applicable law. When responding to a payment dispute, we may provide the booking record, the agreement versions you accepted, and related evidence to our payment processor.
8. Relationship to the Platform Terms
The Pacific Luxe Stays Platform Terms apply to this reservation, including the marketplace-role, disclaimer, limitation-of-liability, indemnification and dispute-resolution provisions. Where this agreement addresses a booking-specific subject, it applies to that reservation.
9. Who you are contracting with, and notices
This reservation is with Pacific Luxe Stays, operated as a sole proprietorship, in its marketplace role described in the Platform Terms, together with the independent host of the property.
Formal, contractual and legal notices to Pacific Luxe Stays must be sent to legal@pacificluxestays.com, and may also be sent by mail to Pacific Luxe Stays, 1551 Kenneth Drive, Santa Ana, CA 92705. Notices to you may be given electronically to the email address on your account. Ordinary customer-support questions should go to support@pacificluxestays.com.
1. One standardized policy
The Pacific Luxe Stays Strict Cancellation & Refund Policy applies to every property on the Platform. Hosts do not set their own cancellation terms. The full terms are shown to the guest before payment, and the version that applied is stored with the booking. A later change to this policy does not alter a reservation that is already confirmed.
This policy describes amounts paid for a reservation through the Platform. Amounts are calculated by the Platform from the stored reservation, not entered by a guest or a host.
2. 24-hour booking grace period
If a guest cancels within 24 hours after paying for a reservation, and the scheduled check-in date is still at least 7 full days away, the reservation is refunded in full, including the nightly accommodation charges, the cleaning fee, any refundable security deposit, applicable lodging taxes and any Platform charge shown to the guest.
3. Cancellation windows
Outside the grace period described above, refunds of accommodation charges are determined by when the cancellation happens relative to the scheduled check-in date:
14 or more days before check-in: the accommodation charges for the reservation are refunded in full.
7 to 13 days before check-in: 50% of the accommodation charges is refunded.
Less than 7 days before check-in: the accommodation charges are not refunded.
On or after the scheduled check-in, including where a guest does not arrive, unused nights are not refunded by default. A host may voluntarily approve a refund in that situation as described in section 7.
4. Cleaning fees
Where a reservation is cancelled before check-in and the stay does not happen, the cleaning fee is refunded in full. A cleaning fee is a charge for a service that is not performed when the stay does not occur, and it is not retained as a cancellation charge.
5. Refundable security deposits
Where a reservation is cancelled before occupancy, a refundable security deposit is released in full unless there is a lawful, documented reason to withhold part of it under the Damage & Security Deposit Policy. A security deposit is never treated as cancellation revenue.
6. Lodging taxes and Platform fees
Lodging, transient occupancy and similar taxes are recalculated against the accommodation amount actually retained, and the corresponding tax collected from the guest is refunded where that tax is no longer due. Where the host is the party responsible for collecting and remitting the tax, the refund is made from the payment account that received it.
Where a refund is issued, the Pacific Luxe Stays marketplace fee is returned in the same proportion as the refunded portion of the nightly accommodation subtotal and the cleaning fee. A full refund of those amounts returns the whole fee; a 50% refund returns half; a cancellation that refunds no accommodation charges does not automatically return the fee.
7. Requests outside the guaranteed policy
A guest may ask the host to refund more than this policy guarantees, and may explain the reason for the request. That decision belongs to the host, who may decline it or approve an additional amount up to the amount still refundable on the reservation. Pacific Luxe Stays facilitates the request, executes an approved refund through the payment system, and records the request, the decision, the amount and the payment result. Pacific Luxe Stays does not decide the request for the host and does not guarantee any outcome.
8. Host cancellations
Where a host cancels a confirmed, paid reservation, the guest is refunded in full: the nightly accommodation charges, the cleaning fee, any refundable security deposit, the associated lodging taxes and any Platform charge shown to the guest. The corresponding marketplace fee is returned. A host may not rely on this policy to retain a guest's payment for a reservation the host cancelled. Repeated host cancellations are flagged for review and may lead to listing or account consequences.
9. When Pacific Luxe Stays may act differently
Pacific Luxe Stays may override the ordinary operation of this policy where reasonably necessary in a specific situation, including where: the property is materially unavailable or unusable; the listing materially misrepresented the property; there is a serious health or safety issue; there is fraud or suspected fraud; a charge was duplicated or made in error; there has been a violation of Platform policies; the host cancelled the reservation; applicable law requires a different outcome; or a payment processor or card network requires it.
This is a limited power exercised for the reasons listed above. It is not a general right to retain a guest's money or to compel a refund for any reason, and it does not limit rights that apply under mandatory law.
10. Modifications, no-shows and refund processing
Date, guest-count and other changes are subject to availability, the host's approval and any resulting price difference. A no-show is treated as a cancellation at the scheduled check-in time unless applicable law provides otherwise.
Approved refunds are issued to the original payment method through Stripe. The time a refund takes to appear depends on the guest's bank or card issuer and is outside our control. Partial refunds occur where only part of a reservation is refundable.
11. Mandatory rights
Nothing in this policy limits refund or cancellation rights that apply under mandatory law. Where an event outside reasonable control prevents a stay, we will apply this policy fairly and in accordance with applicable law.
1. What a security deposit is
Where a listing includes a refundable security deposit, it is collected as part of the booking total and is refundable to the guest under this policy. A security deposit is not a fee: cleaning fees, the Pacific Luxe Stays service fee, and taxes are separate amounts and are not refundable security deposits. A charge is described as refundable only where the Platform is designed to refund it.
2. Guest responsibility for damage
Guests are responsible for damage to the property, its contents or its surroundings caused by the guest or the guest's authorized occupants, to the extent permitted by law. Normal wear and tear is not damage.
3. Host claims process
A host who wishes to claim against a security deposit or seek damage reimbursement must submit the claim within the window stated on the Platform after check-out, and must provide reasonable documentation, such as a clear description of the damage, dated photographs, and repair or replacement estimates or invoices. Claims without adequate documentation are not approved.
4. Review and guest response
Pacific Luxe Stays reviews the claim and gives the guest a reasonable opportunity to respond before any deduction is applied. We do not permit arbitrary or undocumented deductions. Where the parties disagree, we may decline to decide the underlying dispute between them and may release the deposit to the guest.
5. Release of the deposit
Where no valid claim is made within the claim window, the refundable security deposit is released to the guest. Where a claim is approved in part, the remaining balance is released.
6. Amounts owed beyond the deposit
Where documented damage exceeds the deposit, the host may seek the difference from the guest directly, subject to applicable law. Pacific Luxe Stays is not a party to that claim and does not act as an insurer or adjuster.
7. Records
Claim submissions, documentation and decisions are retained as records of the transaction, and may be used when responding to a payment dispute.
Application to this reservation and current deposits
The reservation/property identifiers, dates, guests, itemized totals, currency, applicable cancellation policy snapshot and available house rules displayed with this agreement are recorded as immutable acceptance evidence. If material displayed totals change before payment, review and accept the revised terms before proceeding.
New reservations do not collect security deposits. The deposit and deposit-claims provisions above apply only to historical reservations where a deposit was actually collected; no new deposit collection or automatic damage-debit authority is created.
For cancellations on or after scheduled check-in, the default refund excludes both nightly accommodation and cleaning, including no-shows. Before check-in, cleaning is refunded in full. The marketplace application-fee refund follows the refunded nightly-plus-cleaning base; a separate guest service charge, if any, follows its stored policy (normally nonrefundable outside the full-refund grace period or host cancellation). These are different fees. Tax adjustments follow the stored tax rules and actual taxable amounts. Historical reservations retain their original accepted policy and charge model.
